These terms govern your access to and use of Nous. Please read them carefully — by using the Service, you agree to them.
1. Agreement to these terms
By accessing or using Nous (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These Terms form a binding agreement between you and Nous.
2. The service
Nous provides GTM data infrastructure — a unified, identity-resolved customer record exposed via an API and an MCP server. We may add, change, or remove features at any time, and we will try to give reasonable notice of material changes.
3. Eligibility & accounts
You must be at least 18 years old and able to enter into a binding contract. You are responsible for your account, your API keys, and all activity under them. Keep your credentials secure and notify us promptly of any unauthorized use.
4. Acceptable use
You agree not to misuse the Service, including by: violating any law or any third party’s rights; sending messages in violation of anti-spam or privacy laws; attempting to reverse engineer or disrupt the hosted Service; or using our proprietary code to build a directly competing product.
You are responsible for complying with the terms of any third-party tools you connect through the Service.
5. Plans, billing & refunds
Paid plans are billed in advance on a recurring basis and metered by usage as described on our pricing page. Fees are non-refundable except where required by law. We may change pricing with notice; changes apply from your next billing cycle.
6. Your data & content
You retain all rights to the data you connect or upload (“Your Data”). You grant us a limited license to process Your Data solely to provide and improve the Service for you. You can export or delete Your Data at any time, and we do not sell it.
7. Intellectual property
The Service, including our software, brand, and documentation, is owned by Nous and protected by applicable law. Open-source components are governed by their respective licenses. Nothing here transfers our intellectual property to you except the limited right to use the Service.
8. Third-party integrations
The Service connects to third-party tools such as Apollo, Salesforce, Gmail, and LinkedIn. Your use of those tools is governed by their own terms. We are not responsible for third-party services and may lose access to them at any time.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of liability
To the maximum extent permitted by law, Nous will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, revenue, or profits. Our total liability for any claim will not exceed the amounts you paid us in the twelve months before the claim arose.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to comply with law. On termination, your right to use the Service ends; you may export Your Data before your account is closed.
12. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you. Continued use of the Service after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules.
